GrowthOS Acceptable Use Policy

1. About this policy

1.1 This Acceptable Use Policy ("AUP") sets out what you may and may not do with GrowthOS. It forms part of the Terms of Service between you and SALESSHURU SOFTWARE SOLUTIONS (OPC) PRIVATE LIMITED ("SalesShuru", "we", "us"). Section 7 of the Terms incorporates this AUP. Capitalised terms have the meanings given in the Terms.

1.2 This AUP applies to every User, including Customers and Authorised Users, and to all Customer Content, Inputs and Outputs. Customers must make sure their Authorised Users comply with it.

1.3 This AUP is published as the rules and regulations, privacy policy and user agreement required under Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended) ("IT Rules"), to the extent those rules apply to the Service.

2. Prohibited content

You must not host, display, upload, modify, publish, transmit, store, update or share any information through the Service that:

(a) belongs to another person and to which you have no right; (b) is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relating to or encouraging money laundering or gambling, or an online game that causes user harm, or promoting enmity between groups on the grounds of religion or caste with the intent to incite violence; (c) is harmful to children; (d) infringes any patent, trademark, copyright or other proprietary right; (e) deceives or misleads the recipient about the origin of a message, or knowingly and intentionally communicates misinformation or information that is patently false and untrue or misleading in nature; (f) impersonates another person; (g) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to other nations; (h) contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource; (i) is in the nature of an online game that is not verified as a permissible online game, or is an advertisement or promotion of such a game or of any online game intermediary offering it; or (j) violates any law for the time being in force.

3. Prohibited conduct

You must not:

3.1 Security and integrity

• attempt to gain unauthorised access to the Service, other Users' Accounts or Workspaces, or our systems or networks;
• probe, scan or test the vulnerability of the Service, except as permitted by our Vulnerability Disclosure Policy (coming soon);
• interfere with or disrupt the Service, for example through denial-of-service attacks, excessive automated requests or bypassing rate limits;
• introduce malware or use the Service to distribute it;
• bypass or disable any security, authentication or usage-limit feature.

3.2 Misuse of the platform

• reverse engineer, decompile or disassemble the Service, except where the law expressly allows it;
• copy, frame or mirror the Service, or use it to build a competing product or benchmark it for publication without our written consent;
• resell, sublicense, time-share or otherwise make the Service available to anyone other than your Authorised Users;
• share login credentials, or create Accounts through automated means or with false information;
• scrape or harvest data from the Service, except through the export features and interfaces we provide.

3.3 Communications and data

• use the Service to send spam, chain letters or unsolicited bulk communications;
• upload Personal Data of others without a lawful basis, or upload sensitive data (such as financial account credentials, passwords, health data, biometric data or government identity numbers) unless a feature is expressly designed for it (see the Privacy Policy);
• use the Service to track, profile or monitor children.

3.4 AI Features. Use AI Features in breach of the AI Usage and Output Disclaimer, including to:

• generate content prohibited by Section 2;
• create deceptive synthetic content that impersonates a real person or misrepresents something as real;
• attempt to extract model weights, system prompts or training data, or to jailbreak or circumvent safety controls;
• present Output as human-made where the law requires disclosure that it was AI-generated;
• make automated decisions with legal or similarly significant effects on individuals (for example, hiring or credit decisions) without meaningful human review.

4. Fair use

Paid Plans and free access may have usage limits (for example, on AI generations, Workspaces, storage or Authorised Users) shown on the pricing page or in-app. To be updated before launch If your use significantly exceeds normal patterns and affects the Service for others, we will contact you first where practicable and may temporarily throttle usage.

5. Reporting violations

5.1 To report content or conduct that breaches this AUP, contact our Grievance Officer:

5.2 We will acknowledge reports within 24 hours and handle them within the timelines in Contact and Grievance Redressal, including the expedited timelines for removal requests under the IT Rules.

5.3 To report a security vulnerability, follow the Vulnerability Disclosure Policy (coming soon) instead.

6. Enforcement

6.1 If we reasonably believe you have breached this AUP, we may, acting proportionately to the breach:

• warn you and ask you to fix the issue;
• remove or disable access to the relevant content;
• restrict features (including AI Features);
• suspend or terminate your Account, as described in Section 12 of the Terms of Service; and
• preserve information and report it to law-enforcement agencies, CERT-In or other authorities where required by law.

6.2 Where we remove content or restrict your Account because of a complaint, we will tell you, where the law allows, and give you a chance to respond. If you disagree with a decision of the Grievance Officer on content, you may appeal to the Grievance Appellate Committee (https://gac.gov.in/) within 30 days, as explained in Contact and Grievance Redressal.

6.3 Breaching applicable law may lead to penalties under laws including the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023, the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Protection of Children from Sexual Offences Act, 2012. Where the law requires it, we will report offences to the appropriate authorities.

7. Periodic reminder and changes

7.1 Where the IT Rules require it, we will remind Users of this AUP, and of our right to suspend or terminate access for non-compliance, at the prescribed intervals (currently at least once every three months), by email or in-app notice.

7.2 We may update this AUP as described in Section 18 of the Terms of Service.
